Superior Court To Hear Paws Case

OLYMPIA - The Okanogan County Superior Court will decide whether an animal-rights organization can file criminal charges of animal cruelty against the organizer of the Omak Stampede "Suicide Race."

Supreme Court Commissioner Geoffrey Crooks yesterday sent the case to the Okanogan court following a telephone conference hearing.

The Lynnwood-based Progressive Animal Welfare Society went to the Supreme Court after the Omak District Court rejected PAWS' attempt to bring criminal charges against Stampede president Jack Miller.

The animal-rights organization cited a little-known state law that states that officers of legally recognized humane societies who have been sworn in as peace officers "shall have the power lawfully to interfere to prevent the perpetration of any act of cruelty upon any animal . . ."

Crooks said the superior court, not the Supreme Court, is the proper forum to decide the question.
