Someone floods canal with forbidden water

KLAMATH FALLS, Ore. — Someone opened a Klamath Falls Irrigation head gate yesterday in defiance of a federal court order, sending water gushing down a dry canal.

The gate was opened about three or four inches around 9 a.m. yesterday.

The water continued to flow last night. The Bureau of Reclamation ordered it shut off, but the Klamath Irrigation District says that will take another court order and might take until tomorrow or Tuesday.

County Sheriff Tim Evinger and Irrigation officials say it is up to federal authorities whether to try to prosecute at this point because no state law has been broken. They say it will be up to the FBI to determine whether to prosecute any farmers who take the spilled water out of the canals for irrigation.
